By installing or using the Service, you agree to these Terms on behalf of yourself and the store you represent. If you do not agree, do not use the Service. ### 1. The Service EU Energy Label displays energy class badges, official energy labels, and product information sheets on your Shopify storefront for products you link to the European Product Registry for Energy Labelling (EPREL) by their registration numbers, and — in Manual mode — for products whose materials you provide yourself. The data behind badges, labels, and product information sheets comes from the European Commission's EPREL database. The Service works within your Shopify store. Your use of Shopify itself is governed by Shopify's own terms, not by these Terms. Our [Privacy Policy](/docs/energy-label/legal/privacy-policy.md) explains how we handle data in connection with the Service. ### 2. No compliance guarantee The Service is a display tool. Under [Regulation (EU) 2017/1369](https://eur-lex.europa.eu/eli/reg/2017/1369) and the product-specific delegated regulations, the obligations of a dealer — including displaying energy labels and product information sheets correctly, for every covered product, everywhere your store shows them — rest with you, the merchant. **Installing or configuring the Service does not by itself make your store compliant, and does not transfer those obligations to Staylime.** In particular, it remains your responsibility to determine which of your products are covered by energy labeling regulations, to assign correct EPREL registration numbers to the right products and variants, to place and style badges as the regulations require (including their presence on every page where covered products appear and the size of the class letter relative to your price), and to review your storefront after setup, theme changes, or catalog changes. Our documentation, including the [Energy labeling requirements](/docs/energy-label/getting-started/energy-labeling-requirements.md) page and the [Legal Notice](/docs/energy-label/legal/legal-notice.md), is provided for convenience and is not legal advice. ### 3. Your responsibilities **Your data entries.** You are responsible for the EPREL registration numbers you assign and for keeping them accurate as your catalog changes. An incorrect number displays another product's label. **App configuration.** Badge placement outside the product page is driven by the settings you enter in the app — such as the CSS selectors for your theme's templates. You are responsible for verifying that badges appear as intended after entering or changing these settings, and after theme updates, which can change your theme's markup and require adjusting them. **Manual mode.** Where you use Manual mode, the energy class, label image, and product information sheet are provided by you. You are solely responsible for their accuracy, legality, and your right to use them. **Your store.** You are responsible for your store, its content, and its compliance with applicable law and Shopify's terms. You are also responsible for any use of the Service by your staff, agents, or contractors as if it were your own. ### 4. EPREL data Energy labels, energy class data, and product information sheets are generated by the European Commission's EPREL system from information registered by product **suppliers**. European Commission services hold all rights, titles, and interests in and to the EPREL API and data; the data is provided on an “as is” basis with no guarantees of completeness, accuracy, usefulness, or timeliness. The accuracy of a product's registered data is the responsibility of its supplier — we do not verify or alter it, and we cannot correct errors in EPREL. The Service may cache labels and documents to serve them faster; the availability of the EPREL database and API is outside our control. ### 5. Fees and taxes The Service is offered as a paid subscription billed through Shopify's billing system, on the plan you select when installing the app. Prices are presented before you commit. We may introduce, change, or discontinue features and prices; changes to subscription prices are handled through Shopify's billing processes and do not apply retroactively. You are responsible for any taxes or duties related to your use of the Service. ### 6. Support Support for the Service is described in our [Support Policy](/docs/energy-label/legal/support-policy.md). It covers the operation of the app and help with its configuration in your theme. It does not include legal advice, confirmation of your store's regulatory compliance, or corrections to data registered in EPREL. ### 7. Acceptable use You agree not to: * reverse engineer the Service or circumvent its security or technical limitations; * interfere with the operation of the Service or overload it, including through automation; * upload malicious code or files, or attempt unauthorized access; * use the Service to display materials you have no right to use, or to misrepresent a product's energy data; * resell the Service or use it to provide a competing product; * abuse support (our [Support Policy](/docs/energy-label/legal/support-policy.md) applies). We may suspend or terminate access to the Service for violations of this section. ### 8. Third-party services and force majeure The Service depends on services outside our control — including Shopify and its APIs, the European Commission's EPREL database and API, hosting and network providers. We are not responsible for failures, changes, limitations, or outages of such services, for the content or availability of data registered in EPREL, or for the behavior of third-party apps and code in your store — nor for delays or failures caused by events beyond our reasonable control. ### 9. Intellectual property The Service, including its software and design, is and remains the property of Staylime or its licensors. Energy labels, class arrows, and product information sheets are materials of the European Commission's EPREL system, displayed by the Service under the Commission's conditions of use; they are not Staylime's property and not yours. ### 10. Disclaimer of warranties The Service is provided **“as is” and “as available”**, without warranties of any kind, express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, error-free, or secure, that the data it displays is accurate or complete, or **that use of the Service will result in your store's compliance with any law or regulation**. ### 11. Limitation of liability To the maximum extent permitted by law, Staylime is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill — including fines, penalties, corrective actions, or other consequences of regulatory non-compliance, formal warnings or claims by competitors or market surveillance authorities, loss of sales or business, business interruption, and the display of incorrect or outdated energy data — arising from or related to the Service, even if advised of the possibility. To the maximum extent permitted by law, our total liability for all claims related to the Service is limited to the amounts you paid us for the Service in the 12 months preceding the claim, or USD 100 if you have paid nothing. These limitations apply regardless of the theory of liability — contract, tort (including negligence), strict liability, or otherwise. Some jurisdictions do not allow certain exclusions or limitations; in those cases, these provisions apply only to the maximum extent permitted by applicable law. ### 12. Indemnification You agree to indemnify and hold harmless Staylime and its officers, directors, employees, agents, and suppliers from any claim or demand, including reasonable attorneys' fees, made by any third party or authority arising out of (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; (c) your store's compliance or non-compliance with energy labeling or other regulations, including claims by market surveillance authorities or competitors; or (d) materials you provide through Manual mode. ### 13. Termination You can stop using the Service at any time by uninstalling the app. We may suspend or terminate access to the Service for breach of these Terms or violations of Section 7. Data stored in your own store, such as metafield values, is governed by Shopify's platform rules. Sections 2–4 and 9–12 survive termination. ### 14. Changes to the Service and these Terms We may update the Service and these Terms at any time. The current version of the Terms is always available on this page with its date; material changes take effect when posted. Continued use of the Service after changes means you accept them; if you do not agree to the updated Terms, stop using the Service and uninstall the app. ### 15. Governing law These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in California, and you consent to their jurisdiction. Nothing in these Terms limits any mandatory rights you may have under the laws of your place of residence. ### 16.
